City of Blue Ridge to pay for gravel on Galinski lots

The City of Blue Ridge will be paying to lay gravel on Mike Galinski’s (Green Rocks, LLC) Ada Street lots. 

In a regular meeting Tuesday, February 11, council members agreed to approve the Parking Agreement Addendum “A” for the lots on Ada Street.

City Attorney James Balli introduced the item by saying, “Basically this addendum A just extends the same agreement that we had on one with just EPS (Executive Parking Systems) to the lot that Green Rocks owns.”

When asked about the original agreement, City Clerk Kelsey Ledford said, “The prior agreement is between Green Rocks and Executive Parking Systems. The city is not named in the prior agreement.”

Councilman Nathan Fitts said the city had been concerned about a lack of sidewalks around the lot and questioned if a solution had been made.

Balli replied by saying that Green Rocks, LLC would have to consider that themselves since they own the lot; therefore, the city would not be responsible if any accidents were to occur.

The addendum states the following conditions:

1. The City of Blue Ridge, Georgia shall be considered to be a party to the agreement for the purposes of the terms set forth herein;

2. The city duties under the agreement shall be to perform such grading and surfacing of the parking lot with “crush and run” or the like so as to make the parking lot suitable for the parking of vehicles of the visitors or citizens of the city. Green Rocks, LLC expressly provides permission for the city to enter upon the parking lot and conduct these improvements;

3. In the exchange for the above, and during the entire term of this agreement, Executive Parking Systems, Inc. (EPS) shall monthly tender 40% of the net operating income of the parking lot to the city. Upon request, the city shall be provided an accounting of how the city percentage is calculated. Green Rock, LLC expressly waives any right to any of the city percentage;

4. EPS shall name the city as an “additional insured” for the insurance set forth in Paragraph 8 of the agreement. The city shall have no duty to monitor or otherwise supervise any of the services set forth in the agreement.

5. To the extent any provision set forth in this addendum conflicts with any provision set forth in the agreement, the terms of this addendum shall govern.

During the town hall meeting on parking, Zach Wojohn owner of EPS, Inc. said he got acquainted with the city after buying property in Fannin County and noticing there is a deficiency of parking, and he wants to see the city “thrive.”
