You are hereby notified that the above styled action seeking to establish title to the below described property against JOHN HAROLD RHODES, LORA DORRAINE RHODES, CAPITAL ONE BANK USA, NA, AND ALL PERSONS UNKNOWN WHO CLAIM OR MIGHT CLAIM ADVERSELY TO PETITIONER'S TITLE was filed in the Superior Court of Fannin County, Georgia, Appalachian Judicial Circuit, and that by reason of order for service by publication you are hereby commanded to be and appear at said court within thirty (30) days of the date of the order for service by publication to answer said petition and file pleadings before the Court.
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN THE 8TH DISTRICT, 2ND SECTION OF FANNIN COUNTY, GEORGIA, BEING A PART OF LAND LOT NOS. 285 AND 292, MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHEAST CORNER OF THE PROPERTY CONVEYED AT AN IRON PIN ON THE WEST SIDE OF A GRAVELED ROAD, SAID POINT OF BEGINNING BEING THE FOLLOWING CALLS AND DISTANCES FROM THE SOUTHEAST CORNER OF LAND LOT NO. 285 (NORTHEAST CORNER OF LAND LOT NO. 292): FROM SAID ORIGINAL CORNER NORTH 0 DEG. 11 MIN. EAST A DISTANCE OF 200 FEET; THENCE NORTH 89 DEG. 49 MIN. WEST A DISTANCE OF 422.68 FEET TO SAID POINT OF BEGINNING, AND FROM SAID POINT OF BEGINNING RUNNING THENCE WITH THE WEST SIDE OF SAID GRAVELED ROAD SOUTH 10 DEG. 59 MIN. EAST A DISTANCE OF 312.84 FEET; SOUTH 10 DEG. 31 MIN. EAST A DISTANCE OF 123.20 FEET TO AN IRON PIN AT THE SOUTHEAST CORNER OF THE PROPERTY CONVEYED; THENCE NORTH 87 DEG. 07 MIN. WEST A DISTANCE OF 299.72 FEET TO AN IRON PIN ON THE BANK OF SUGAR CREEK; THENCE NORTH 87 DEG. 07 MIN. WEST A DISTANCE OF 10 FEET TO THE CENTER OF SUGAR CREEK; THENCE UP THE CENTER OF SAID CREEK A NORTHERLY DIRECTION A DISTANCE OF 424.82 FEET; THENCE SOUTH 89 DEG. 33 MIN. EAST A DISTANCE OF 295.14 FEET TO THE IRON PIN AT THE POINT OF BEGINNING, AND CONTAINING 2.8 ACRES, MORE OR LESS.
SAID PROPERTY IS SHOWN ON PLAT OF SURVEY BY FRANKLIN D. RUSSELL DATED OCTOBER, 1977, AS SUBDIVISION LOT NO. 4, SAID PLAT BEING RECORDED IN PLAT BOOK 9, PAGE 171, FANNIN COUNTY RECORDS.
SAID PROPERTY IS CONVEYED SUBJECT TO ALL EASEMENTS, RESTRICTIONS, AND RIGHT OF WAY AS SET FORTH ON SAID RECORDED PLAT OR AS APPEARING OF RECORD.
THE ABOVE DESCRIBED PROPERTY IS THE SAME PROPERTY CONVEYED BY WARRANTY DEED DATED THE 5TH DAY OF APRIL, 1979 RECORDED IN DEED BOOK 64, PAGE 482, FANNIN COUNTY DEED RECORDS.
