NOTICE OF SALE UNDER POWER
GEORGIA, FANNIN COUNTY
Under and by virtue of Power of Sale contained in the Security Deed from Serena Schrage aka Serena Lynn Schrage and Tanisha Michelle Turner, to Vanderbilt Mortgage and Finance, Inc., dated March 21, 2018, filed for record April 9, 2018, recorded at Deed Book 1247, Page 426, Fannin County, Georgia Records, in the original amount of $105,528.96, aforesaid records together with a Promissory Note of equal date and value, with interest at the rate specified therein, there will be sold, by the undersigned at public outcry to the highest bidder for cash, before the Courthouse Door, or designated area at FANNIN COUNTY, Georgia, or designated area, within the legal hours of sale on the first TUESDAY in APRIL 2024, the following described property:
Being a tract of land located in the Land Lot No. 76, 8th District, 2nd Section, Fannin County,
Georgia. Said Tract of land is known as Lot #11 of the A.L. Stepp property, containing 1.51 acres, more or less, located off Wash Wilson Road.
To arrive at the TRUE POINT OF BEGINNING, begin at the intersection of Wash Wilson Road and a 12 foot field road, begin at an iron pin set on the northwest Right of Way at the intersection of said roads; thence along the northwest Right ofWay of said road, the following courses and distances: North 49 degrees 13 minutes East, a distance of 170.4 feet; thence North 44 degrees 50 minutes East, a distance of 155 feet; thence North 80 degrees 10 minutes East, a distance of 83 feet; thence North 51 degrees 26 minutes East, a distance of 113.8 feet; thence North 74 degrees 28 minutes East, a distance of 121.1 feet; thence North 79 degrees 52 minutes East, a distance of 51.3 feet; thence North 17 degrees 32 minutes East, a distance of 169.6 feet; thence North 39 degrees 37 minutes East, a distance of 94.8 feet; thence North 58 degrees 14 minutes East, 261 feet; thence North 04 degrees 49 minutes East, a distance of 86.8 feet to an iron pin, being the TRUE POINT OF BEGINNING; thence North 13 degrees 28 minutes East, a distance of 84.2 feet; thence North 02 degrees 30 minutes East, a distance of 125.1 feet; thence North 13 degrees 32 minutes West, a distance of 95.1 feet; thence South 80 degrees 19 minutes West, a distance of 414.6 feet to an iron pin; thence North 60 degrees 30 minutes West, a distance of 406.3 feet to the POINT OF BEGINNING.
Being the same property conveyed to Sierena Schrage by Quitclaim Deed from Darlene Stiles dated September 8, 2016 and filed of record in Book 1062, page 31, Clerk of Superior Court for Fannin County, Georgia.
Page Said legal description is controlling but the property is commonly known as 236 Wash Wilson Road, Blue Ridge, Georgia 30513.
Tax and Parcel ID Number: 0059B69L.
The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note, including, but not limited to, the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees and other payments provided for under the terms of the Security Deed and Note.
Said property will be sold subject to the following items which may affect the title to said property: all zoning ordinances; matters which would be disclosed by an accurate survey or by inspection of the property; any outstanding taxes, including but not limited to, ad valorem taxes, which constitute liens upon said property; special assessments; and all outstanding bills for public utilities which constitute liens upon said property; To the best of the knowledge and belief of the undersigned, the party in possession of the property is Serena Schrage aka Serena Lynn Schrage and Tanisha Michelle Turner and /or tenant(s).
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the United States Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed. VANDERBILT MORTGAGE AND FINANCE, INC. and its counsel are acting as debt collectors. Any information obtained will be used for that purpose.
